I, the undersigned, have chosen to use the property and amenities at Granite Point Resort ("Resort" or "Granite Point") including swimming (with the understanding that there is no lifeguard on duty and any use of the lake is at my/our own risk), use of all common areas of the Resort including sports courts, playfields, and play equipment), and participation in any permitted use upon the Resort property, including but not limited to passage or entry upon any docks, hiking and exploring, renting boats, kayaks, canoes, paddle boards, pedal boats or other equipment (such as horseshoes, basketball, and pickleball).
In choosing to use the grounds and shoreline of Granite Point, I understand that various activities I choose to undertake can be dangerous and risk injury to myself, members of my family and/or other guests of mine. These include but are not limited to, swimming, diving, boating, using walkways and pathways throughout the park which may be unlit and without railings, participating in sports such as baseball, soccer, volleyball, pickle ball, basketball, horseshoes, use of propane or charcoal barbecues, crossing the railroad tracks, and other resort activities, none of which are supervised by Granite Point staff or employees.
I, for myself and on behalf of those for whom I am signing, herby RELEASE AND HOLD HARMLESS Granite Point Park Company and its owners, agents, and employees ("Released Parties"), from any and all claims and liability for injury, loss, or damages resulting from the use of the Resort or any amenities or activities offered therein. This release includes claims for the negligence of any Released Parties, except for gross negligence, or intentional misconduct that are precluded by Washington law from being excluded by this agreement. I, on behalf of myself and those whom I am signing, agree NOT TO SUE or make a claim against the Released Parties for any injuries, loss, or harm that occur as a result of our presence on the Resort or use of its facilities.
This agreement shall be enforceable as a release of liability as broad and inclusive as is permitted by Washington law, and if any portion is found unenforceable, the remainder will continue in full force and effect.
I HAVE READ AND FULLY UNDERSTAND THIS AGREEMENT AND MADE THE CONTENTS KNOWN TO THOSE ON WHOSE BEHALF I AM SIGNING. I WILL CONDUCT MYSELF AND ENSURE THAT THOSE ON WHOSE BEHALF I AM SIGNING, CONDUCT THEMSELVES IN A SAFE AND RESPONSIBLE MANNER AT ALL TIMES AND COMPLY WITH ALL THE RULES AND REGULATIONS OF THE RESORT.
I AGREE TO INDEMNIFY AND HOLD HARMLESS AND DEFEND THE RELEASED PARTIES AGAINST ANY AND ALL CLAIMS TO WHICH THIS AGREEMENT APPLIES AND ACKNOWLEDGE THAT I SHALL BE JOINTLY AND SEVERALLY LIABLE FOR ALL OBLIGATIONS UNDER THIS AGREEMENT TO THE EXTENT 1 AM SIGNING ON BEHALF OF ANY PERSON INTENDED TO BE BOUND BY THIS AGREEMENT.
WE AGREE THAT THIS RELEASE AND WAIVER SHALL BE IN FULL FORCE AND EFFECT FOR AS LONG AS WE USE THE RESORT, UNLESS AND UNTIL EXPRESSLY WITHDRAWN IN WRITING PROVIDED TO AND ACKNOWLEDGED IN WRITING BY THE RESORT.
